Terms of Service

1. The Service

Prewear is a Chrome extension and related website, checkout, and backend service for AI virtual try-on. You can select or upload a reference photo, choose a product image on a shopping page, and request an AI-generated image that approximates how the selected item might look on the person in the reference photo.

Prewear is not a retailer, marketplace, stylist, sizing tool, or product warranty. We do not sell, ship, inspect, endorse, or guarantee products shown on third-party shopping sites. The retailer's own product page, policies, prices, availability, shipping terms, returns, and descriptions control your relationship with that retailer.

2. Eligibility and Adult Use

You must be at least 18 years old and able to enter a binding contract to use Prewear. You may use Prewear only for yourself or with the clear permission of the person shown in any uploaded photo. You may not upload photos of minors.

By uploading a photo or requesting a try-on, you confirm that you have all rights and permissions needed to use that photo with Prewear and to let us process it as described in these Terms and our Privacy Policy.

3. Your Content and License to Prewear

"Your Content" means the photos, prompts, page context, product image selections, and other materials you submit, select, or make available through Prewear. You keep any rights you already have in Your Content.

You grant Prewear a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, transform, transmit, display, and otherwise process Your Content only as reasonably needed to provide, maintain, secure, troubleshoot, and support Prewear. This includes generating, caching, returning, and displaying AI try-on outputs.

You are responsible for Your Content and for your use of any product images or page content from third-party shopping sites. Prewear does not grant you rights in retailer photos, trademarks, product listings, or other third-party materials.

Prewear does not claim ownership of your uploaded reference photos or generated outputs. You understand that AI services may produce similar or identical outputs for other users.

4. Acceptable Use

You agree not to use Prewear to:

• upload or process a photo of anyone without their permission;
• upload or process any photo of a minor;
• create sexual, exploitative, harassing, hateful, deceptive, defamatory, or unlawful content;
• impersonate someone, misrepresent generated content as a real photo, or deceive others;
• infringe privacy, publicity, intellectual property, or other rights;
• violate a retailer's site terms or access restrictions;
• reverse engineer, scrape, copy, overload, disrupt, or probe Prewear or its systems;
• bypass credits, rate limits, security controls, payment flows, or access restrictions;
• introduce malware or harmful code; or
• use Prewear in a way that violates applicable law or third-party AI service policies.

We may block, remove, refuse, or report content or activity that we believe violates these Terms, creates risk, or may harm Prewear, users, third parties, or service providers.

5. Credits, Payments, and Refunds

Credits

Prewear try-ons may require credits. New devices may receive a limited number of free try-ons. Additional credits may be sold in packs shown in the extension or checkout. Credits are a limited, revocable license to use Prewear. They are not cash, stored value, a bank account, a gift card, or transferable property.

Device and email records

Credits are tied to a device-token record. If you clear browser storage, reinstall the extension, change devices, or reset Chrome, you may lose access to credits unless they can be restored through the email used for your receipt. We may not be able to restore credits without enough information to locate the purchase.

Payment processing

Payments are processed by Stripe. Prices, taxes, and available credit packs are shown at checkout and may change prospectively. You authorize us and Stripe to charge the payment method you provide for the selected purchase. Prewear does not receive or store your full card number.

Failed generations and refunds

Prewear is designed so a failed generation does not spend a credit before a result is delivered. If you believe a credit was incorrectly spent or purchased credits were not delivered, contact support@prewear.fit.

Except where required by applicable law or where we determine that Prewear failed to deliver purchased credits or charged credits incorrectly, purchases are final and non-refundable. Free try-ons have no cash value.

6. Third-Party Sites and Services

Prewear depends on third-party services, including Google Gemini for AI generation, Stripe for payments, Supabase for credit records, Render for backend hosting, Vercel for website hosting, Chrome for extension functionality, and shopping sites where you choose to use the extension. These third parties are not controlled by Prewear and may have their own terms, privacy notices, fees, policies, outages, or restrictions.

We are not responsible for third-party shopping sites, retailer products, retailer content, payment networks, browser behavior, AI provider outages, or third-party terms. You are responsible for complying with third-party terms that apply to your use.

7. Prewear Intellectual Property

Prewear, including the extension, website, backend, software, designs, text, graphics, logos, trademarks, trade names, and other materials, is owned by Wizrd On-Demand Technologies Inc. or its licensors and is protected by intellectual property laws.

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to install and use Prewear for its intended purpose. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from Prewear except as allowed by law or with our written permission.

If you send feedback or suggestions, you grant us the right to use them without restriction or compensation.

8. Privacy

Our Privacy Policy explains how we collect, use, store, and share information. By using Prewear, you agree that we may process information as described in that policy.

9. Suspension and Termination

You may stop using Prewear at any time by uninstalling the extension and, if you want backend data deleted, contacting us. We may suspend, limit, or terminate your access to Prewear if we believe you violated these Terms, created legal or security risk, misused credits, abused the service, or caused harm to Prewear, users, third parties, or service providers.

Termination does not limit rights or obligations that should reasonably survive, including payment obligations, intellectual property rights, disclaimers, limitations of liability, indemnity, governing law, and records we must retain for legal, security, fraud-prevention, accounting, or dispute purposes.

10. Disclaimers

Prewear and all outputs are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, conditions, and representations, whether express, implied, statutory, or otherwise, including merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, uninterrupted operation, and error-free operation.

AI-generated outputs can be wrong, distorted, unrealistic, biased, incomplete, offensive, or inconsistent. They are not professional advice and are not a substitute for checking retailer size charts, measurements, return policies, product details, colors, materials, or reviews. You are responsible for your purchase decisions.

11. Limitation of Liability and Indemnity

To the maximum extent permitted by law, Wizrd On-Demand Technologies Inc. and its directors, officers, employees, contractors, agents, affiliates, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, business interruption, or purchase decisions, even if advised that such damages are possible.

To the maximum extent permitted by law, our total liability for any claim related to Prewear or these Terms will not exceed the greater of CAD $50 or the amount you paid to Prewear for credits in the three months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

You agree to defend, indemnify, and hold harmless Wizrd On-Demand Technologies Inc. and its directors, officers, employees, contractors, agents, affiliates, suppliers, and licensors from claims, damages, liabilities, losses, and expenses arising from Your Content, your use of Prewear, your violation of these Terms, your violation of law, or your violation of another person's rights.

12. Governing Law and Venue

These Terms and any dispute relating to them or Prewear are governed by the laws of Ontario, Canada and the applicable federal laws of Canada, without regard to conflict-of-laws rules.

Subject to any mandatory rights you may have under applicable consumer or privacy laws, you and Prewear agree to the exclusive jurisdiction of the courts located in Ontario, Canada for disputes relating to these Terms or Prewear.

13. Changes to These Terms

We may update these Terms from time to time. The effective date above shows when this version took effect. If changes are material, we will provide notice as required by law, such as through the website, extension listing, checkout, or in-product notice. Your continued use of Prewear after updated Terms take effect means you accept the updated Terms.
